Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, mobile applications, and content made available by Tuun (the “Service”), operated by Radiant Technologies L.L.C-FZ, a free-zone limited liability company registered at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates (“Tuun,” “we,” “us,” or “our”).

By creating an account, taking the quiz, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Tuun

You must be at least 18 years old to use the Service. By using Tuun you represent that you are 18 or older and that you have the legal capacity to enter into these Terms. The Service is not directed at children, and we do not knowingly collect information from anyone under 18.

If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. What Tuun is — and is not

Tuun is a wellbeing product that delivers short, structured daily-card content and tools designed to support self-reflection, behavior change, and nervous-system awareness. Tuun is not a medical device, not a substitute for therapy, and not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. Nothing in the Service is intended to diagnose, treat, prevent, or cure any condition.

Always seek the advice of a qualified healthcare professional with any questions you may have about your physical or mental health. Never disregard professional advice or delay seeking it because of something you read or experienced through Tuun.

If you are in crisis or believe you may be a danger to yourself or others, contact emergency services immediately (988 in the US/Canada, Samaritans 116 123 in the UK and Ireland, Lifeline 13 11 14 in Australia, or your local emergency number).

3. Accounts

To access most of the Service you’ll need an account. You agree to provide accurate, current, and complete information during sign-up and to keep that information up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us at hello@usetuun.com if you suspect any unauthorized use.

We may suspend or terminate accounts that violate these Terms, including without limitation accounts engaged in fraud, abuse, or attempts to circumvent payment.

4. Subscriptions, billing, and refunds

Tuun is offered on a subscription basis (monthly or annual) and as a one-time lifetime purchase. Plan prices, billing cadence, auto-renewal, cancellation, and refund details are governed by our Subscription Policy, which forms part of these Terms.

By subscribing you authorize us, our payment processor, and any platform you purchase through (e.g., Apple App Store, Google Play, Stripe) to charge your selected payment method on the schedule disclosed at checkout, including automatic renewals at the then-current rate until you cancel.

5. Acceptable use

You agree not to:

use the Service in violation of any applicable law or regulation;
access, copy, scrape, or download the Service or its content for any purpose other than personal, non-commercial use;
reverse engineer, decompile, or attempt to extract source code from the Service;
resell, sublicense, or share access credentials with anyone outside your household;
upload content that is unlawful, defamatory, harassing, infringing, or that contains malware;
impersonate any person or misrepresent your affiliation with any person or entity;
interfere with the integrity, performance, or security of the Service.

We may remove content and suspend or terminate accounts that violate this section, with or without notice.

6. User content

You may submit reflections, journal entries, quiz responses, survey answers, and other content to the Service (“User Content”). You retain ownership of your User Content. You grant Tuun a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and process your User Content solely as necessary to operate, improve, and provide the Service to you, and as further described in our Privacy Policy.

You represent that you have all rights necessary to submit your User Content and that it does not violate any law or third-party right.

7. Intellectual property

The Service — including all daily cards, lessons, audio, video, copy, design, software, brand marks, and “Tuun” itself — is owned by Tuun or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

No other rights are granted. All rights not expressly granted to you are reserved by Tuun and its licensors.

8. Third-party services

The Service may link to or integrate with third-party services (e.g., payment processors, analytics providers, app-store platforms). We are not responsible for, and do not endorse, any third-party services or their content. Your use of third-party services is governed by the terms and privacy policies of those services.

Tuun is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., Facebook, Instagram, Google, or Apple Inc. Trademarks referenced belong to their respective owners.

9. Changes to the Service

We may add, change, suspend, or discontinue features of the Service at any time. We may also change these Terms; if we make material changes we will notify you (e.g., by email or by posting a notice on the site) before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUUN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, TUUN MAKES NO REPRESENTATION OR WARRANTY THAT USE OF THE SERVICE WILL RESULT IN ANY SPECIFIC OUTCOME, INCLUDING WITHOUT LIMITATION ANY IMPROVEMENT IN MOOD, ENERGY, FOCUS, NERVOUS-SYSTEM REGULATION, OR ANY OTHER PHYSICAL OR MENTAL STATE. INDIVIDUAL RESULTS VARY.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TUUN, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT TUUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TUUN’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO TUUN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Tuun, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.

13. Termination

You may stop using the Service at any time. You may cancel a subscription at any time per the Subscription Policy. We may suspend or terminate your account or access to the Service at any time, with or without cause or notice, including for violation of these Terms.

Sections that by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution — will survive.

14. Governing law and disputes

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC), without regard to its conflict-of-laws rules. The DIFC Courts will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

If you are a consumer resident in a jurisdiction whose law guarantees you the right to bring proceedings in your local courts, nothing in this section limits that right.

15. Miscellaneous

These Terms, together with the Privacy Policy, Cookie Policy, Subscription Policy, and Wellness Disclaimer, constitute the entire agreement between you and Tuun regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
